Patent law

January 5, 2010 | Attorneys

Patent law can be a rather complicated affair. While a patent offers an exclusionary right, it does not necessarily provide the owner the right to exploit the specific patent. If the patent refers to an improved version of an already existing patent, the owner of the improved patent only owns the right to the features he added to the existing product, and still need the permission of the original patent owner to produce the product. The opposite is also true. If the owner of the original patent then wants to improve his invention in a similar manner, he needs the permission of the improved patent owner to do this.
