Intellectual Property News and Interesting Facts
Who would have thought that the cute smileys such as
can become a hot point for disputes?
Although the smileys originated from keyboard strokes, one web company years ago trademarked one such a smiley as part of its logo.
The company brought lawsuits against millions of users – the largest trademark lawsuit campaign of its kind ever!
There is now a Russian company that has trademarked the smiley frown and users are warned not to use it anymore.
If you are in Russia you could very well find yourself at the other end of a trademark lawsuit simply for using the emoticon.
Users around the world according to some sources may very well find that interfaces will block emoticons in future- no doubt making casual correspondence a bit boring for some.
One blogger suggested that the problem of a trademark lawsuit would only exist if another company in Russia uses the emoticon in their advertising or branding.
Discussions are ongoing and feel free to give your input on trademark rights for smileys.
