Patent law can be a rather complicated affair. While a patent offers an exclusionary right, it does not necessarily provide the owner the right to exploit the specific patent.
If the patent refers to an improved version of an already existing patent, the owner of the improved patent only owns the right to the features he added to the existing product, and still need the permission of the original patent owner to produce the product.
The opposite is also true. If the owner of the original patent then wants to improve his invention in a similar manner, he needs the permission of the improved patent owner to do this.

A patent lawyer is a lawyer who has the qualifications that are necessary for representing clients in obtaining patents and for acting in all matters and procedures relating to patent law and practice.
In order to become a patent lawyer in South Africa, an attorney must have not only his Law degree, but also an engineering or science degree, and must have completed and passed the examinations set by the South African Institute of Intellectual Property Law.
Once he or she has these three qualifications he or she may call himself or herself a patent lawyer. A patent lawyer is able to give an inventor sound advice as to whether the invention shows inventiveness or not.

The patent lawyer will help an applicant to successfully complete all required forms, sign the relevant documentation and assist in drawing up specifications, ensure that there is agreements of transfer of rights where relevant, and will handle both the ZA and the Paris Convention applications.
The patent lawyer also guides the applicant through the process and does an extensive patent search at the registries and through databases on behalf of the client.
The patent lawyer will assess the patent application to ensure novelty, originality, and non-publication prior to the priority date of application. In addition the patent lawyer will assist in the drawings through the use of an expert in the field and will also handle the contracts or agreements where required on behalf of the client.
The patent lawyer is essential for successful completion of applications.
