Is it possible to patent food recipes in South Africa?  The South African Patents Act does not reject recipes for patent protection, but recipes must be subject to the provisions of the Act. The recipe  has to be new, involve an inventive step and be capable of being used in trade, industry or agriculture.

A method of combining ingredients is patentable according to the Patents Act, but merely combining certain ingredients may only be patentable if the ingredients have never been combined before or the combining order is new. These combined ingredients would also have to result in something new and not be obvious.

Paris Convention

The Paris Convention applies to patents, marks, industrial designs, utility models, trade names, geographical indications and the repression of unfair competition. The Paris Convention for the Protection of Industrial Property was signed in Paris, France, on March 20, 1883, and was one of the first intellectual property treaties.

The Paris Convention established a Union for the protection of industrial property. The Convention is still in force. As of December 2011, the Paris Convention has 174 contracting member states,which makes it one of the most widely adopted treaties worldwide.

Patent Laws in Europe: James Dyson

British innovator and inventor James Dyson built a multi-billion dollar empire from inventing vacuum cleaners.

He said patent laws across Europe are unhelpful for inventors and small businesses, and that he has been affected enormously by people copying his ideas.

James Dyson told CNN that the patent system in Europe needs to be radically overhauled.

He points to the red tape surrounding the patenting process as being a massive hurdle for businesses wanting to develop ideas.

James Dyson said that the problem with inventing is that as soon as you file a patent, competitors see what you are doing and they can work around it.

He is also an outspoken critic of Chinese counterfeiters, calling on governments to do more to protect intellectual property rights.

James Dyson calls for obvious disputes to be dealt with without the parties going through a protracted legal battle.

He also believes that a Europe-wide patent is the answer to the problem of “You have to file in each country, you have to translate in each country, sue in each country, renew in each country.

Pfizer‘s patent for it’s popular cholesterol-lowering drug Lipitor will expire on 30 November 2011, paving the way for more affordable generic versions.

Generic drugs have the same active ingredient as original drugs, but tend to be significantly less expensive.

More than 17 million people have been using Pfiser’s cholesterol-lowering drug, Lipitor, also know as Atorvastatin.

Atorvastatin is a member of the drug class known as statins, used for lowering blood cholesterol.

It also stabilizes plaque and prevents strokes through anti-inflammatory mechanisms.

The patent for Lipitor / Atorvastatin was scheduled to expire in June 2011, but Pfizer made arrangement with Ranbaxy Laboratories to delay the generic launch in the U.S. until November 2011.

The primary uses of Lipitor / Atorvastatin is for the treatment of dyslipidemia and the prevention of cardiovascular disease.
