Trademark Symbols and the usage thereof

Intellectual Property News and Interesting Facts

The trademark symbol is designated by the letters TM written in superscript style. In practice it will look like this: Product ™ . It is used directly after the logo, mark, or slogan that is trademark registered.
When the trademark is not yet registered with the specific trademark office you will see an “R” in superscript surrounded by a circle after the logo, name or slogan. It will look like this: Product®.
There is a proper procedure for displaying the trademark as described and companies frequently issue statements on the Internet regarding the appropriate and allowable usage and display of their trademark by another entity even in referencing the trademark.
An unregistered trademark usage infringement can be enforced by virtue of common law. To ensure that you are not infringing on an existing trademark through the usage of a symbol, logo, design or name, get in contact with our lawyers to conduct a trademark search on your behalf.

Hello
WE would like start a small brand name of clothing, where we will just be printin things on shirts and selling them for a prifit and would like to eventualy evolve. We have chosen the name “pyrodice”.
We have also search the name on various search engines and no links or results were found. That said we would like to do things the right way and clever way and would like to trademark our name and logo, however we do not have enough money at the moment to go through the procedure of registering our name and logo.
We would just like to make sure that we could use the tm or “r” trademark symbol on the shirts to let people know that we have rights to the idea or ideas.
Your Sincerely
Jessica and J.J

You are allowed to use TM in combination with your mark, but it is an offense to use R in combination with the mark if the mark has not in fact been registered. Also keep in mind that you can file a trade mark at a later stage when more money becomes available, but you run the risk of a third party starting to use or even register the mark thereby obtaining rights of their own.
