Completion of the Design Registration Application Forms
The design registration application forms must be completed accurately to ensure that your design application is successful and that protection will be to the maximum. To this end we recommend that you make use of our intellectual property attorneys to assist in the completion of the design registration application forms obtainable from CIPRO.
The application must be made in the correct classes to ensure protection within those classes against infringement. The classification lists are also obtainable from CIPRO or directly from us. You may file the application as an individual or company or make use of our attorneys to handle the process professionally on your behalf. We will also do a patent journal and database search to determine that there are no other conflicting applications or designs. This is called a novelty search and we carry it out at the Paper Based Disclosure Centre of CIPRO. Once the novelty search has been completed the preparation of the design registration application forms is done. There are various forms to be completed including:
- D1 (must be completed in duplicate)
- D2 ( to be completed in duplicate)
- D6 (duplicate completion required)
- D8 (to be completed in duplicate)
The registration fee must also be paid. The application forms should be accompanied by presentations of the design on A4 size paper. The presentations can take the form of photographs or drawings. Where possible, drawings should be submitted without any side notes apart from notes about which view is indicated. If photographs are submitted, the photos must be studio quality. There may not be any details other than the article including a person or background, in the picture. Should it be necessary to include another object in the photo for the purpose of indication, then you will need to write a disclaimer as it must be excluded from the protection.
