People compare Products

When people compare product features they more often than not look at the trademarks and where applicable registered designs as well.

The reasons why people sometimes compare product features and brand names are mostly because of the following:

  • They want to make fashion statements and specific brand names whether in clothing, sports gear, vehicles, or electronic equipment provide the prestige associated with the specific names.
  • Quality is often associated with specific brand names and as such people have the perception that they get value for money.
  • People prefer brand names because of guarantees associated with the vendor.

From the above it is apparent that companies receive more attention, prestige and can ask higher prices for their items since people compare product names when they shop. Non-branded items are often associated with poor quality even when the opposite is true.

Unknown makes carry a certain amount of risk for the consumer. Pirated items such as copies of Nike shoes, may sell well at some markets, but people who purchase in well-known establishments prefer the original items.

It is however, important to register any trademarks, brand names, and designs before using them to mark items. Without registration the owner of the brand name will not have any grounds for litigation should the design, brand name or trademark be copied or used to promote a similar item.

Keep in mind that people compare product names just as they look at price, functionality and appearance.

To ensure that you don’t infringe on the rights of another entity, make use of trademark, design and patent lawyers to get the logo, design, or name registered.
