The open patent movement has developed as a community that aims to have patents shared under a specific license.

This type of license can be for instance, the copyleft license. The open patent movement thus wants to create an environment where patented work can be utilized by the parties involved in the agreement. Should changes be made to the invention new licensing will be needed and it would be given to the original institution.

What is the benefit?

It allows for more usage of patents without the risk of lawsuits amongst the users who are part of the agreement. The cost for this usability, is that the users agree not to build their own inventions from the one used.

The concept is not new. These types of rights and usage allowance have been practiced by research institutions and groups for many years.

The patent movement has in many cases objected to software patenting, in the belief that patenting software leads to monopolies and limitations regarding intellectual growth. There are several members in the pressure group, and the most notable of actions is that of Linux versus Window platforms.

The main idea is to open software and computer technology up so that everyone can benefit and contribute whereas with a close patented philosophy only the rights holder benefit and development accordingly becomes limited.

More on the copyleft term

It refers to the idea of removing restrictions on the distribution of copyrighted works including some of the software. This also falls under the goals of the open patent movement.
