Trademark Registration Certificate

Value Of The Trademark Registration Certificate

The Trademark Registration Certificate is only issued by the particular country’s Trademark Office once the application has been completed, the assessment done, requirements met and no opposition filed during the period in which the trademark application is advertised.

Initially, a trademark search is done by the intellectual property attorneys who have been appointed by the client. This is necessary to establish whether the trademark is indeed original, applicable and not already in use by another party. Even if it is not 100% the same, but only similar to an existing trademark, the Trademark Registration Certificate will not be issued.

Why Is The Trademark Registration Certificate So Important?

It is important because once you have it; it provides you the right to mark products for which the trademark has been registered with the relevant marking. It is also an intangible asset which can be assigned to another person. As such one will want to get the Trademark Registration Certificate also for the capital value associated with such.

When a trademark or intellectual property valuation is done for the purpose of selling a business, not only the costs involved in registering and renewing the trademark, but also the potential in royalties’ income and market status will be valued. As such the Trademark Registration Certificate is the evidence required that one has the right to use the trademark and also has the right to assign it.

Each country has its own procedures to follow for a trademark application and specific requirements to be met. It must be noted that in South Africa, the trademark application is submitted to the South African Trademark Office.

A Trademark Registration Certificate can be issued for a unique logo, wording, lettering, shape or configuration of all, to uniquely resemble the company’s products or services for which trademark registration was obtained.
